Parents allege driver using FaceTime caused daughter’s death

The parents of a 5-year-old girl are suing Apple, saying that FaceTime, an app on Apple’s iPhone, is responsible for the death of their daughter.

Their daughter lost her life in 2014 in a Christmas Eve car crash. A 22-year-old man in a Toyota 4Runner rear-ended the plaintiff’s Camry at 65 mph. the 4Runner drove up over the driver’s side of the Camry, and the little girl was in the back seat behind the driver. Both the father and the child suffered critical injuries. The 5-year-old was taken by helicopter to a hospital, but she later passed away due to her injuries. the parents and another child, an 8-year-old girl, were transported to the hospital by ambulance.

The driver is facing manslaughter charges in Texas, where the accident occurred. The parents’ lawsuit is filed in California against Apple, and claims that if the tech giant had used “lock-out” technology in their phones, that the other driver could not have been logged into the app while he was driving. The lawsuit also claims that a patent was issued in 2014 for the lock-out feature, but never used it. It would have prevented people from using the app when driving. The lawsuit also says that Apple didn’t do enough to warn drivers how dangerous it was to use the app.

Apple has not commented publicly on the lawsuit.
