Large Reward For Malpractice Case

Supreme Court jury offers Large Reward for Legal Malpractice Case to the family of an Ellenville man. The family was received 4.62 Million in compensation for the case. 

The verdict came this week following a two-week trial concerning the death of Walter Friedlander, 63, on Feb. 15, 2011 from a severe infection, according to the family’s lawyer. Judith Livingston helped the family to claim the Large Reward for Legal Malpractice Case (4.65 Million). She is part of the Manhattan law firm of Kramer, Dillof, Livingston & Moore in Manhattan.

Livingston said Wednesday that Friedlander was admitted to Kingston Hospital on Feb. 13, 2011, and was seen by Dr. Doug Heller, an internist. Dr. Nicholas Golden, a gastroenterologist, was brought in as a consultant, she said. However, the two doctors did not communicate with each other and no one returned to diagnose Friedlander. “No one treated him or even called to see how he was doing,” Livingston said.

The Supreme Court jury of three men and three women deliberated less than an afternoon before finding the two doctors and the hospital responsible for Friedlander’s death and calculating the award for pain and suffering.

A spokesman for Kingston Hospital’s current corporate parent, Health Alliance of the Hudson Valley, said Wednesday, “We disagree with the jury’s verdict and will make a motion to set it aside. We also reserve the option to file an appeal.”
