Wrongful Death Lawsuit Filed By Family Of Infant Killed In Trailer Park Fire

Los Angeles-based attorney James Pocrass is representing the parents and sister of the infant, who died in the Jan. 24 blaze at the south end of Four Js Trailer Park in the 100 block of McCord Avenue. The father suffered serious burns as he tried unsuccessfully to save his daughter from the flames. “This was a fire waiting to happen,” Pocrass said Thursday. The lawsuit states conditions at the property created an unreasonable risk of harm. “Specifically, the mobile homes lacked fire/smoke detectors and carbon monoxide detectors as required by law, had faulty electricity and wiring, lacked waterproofing, lacked weather protection, lacked adequate heating, lacked adequate plumbing, and lacked permits which created an unreasonable risk of a fire which could cause serious injury and death,” the lawsuit states. Jenica died as a direct result of the defendants’ negligence, according to the lawsuit. It states the defendants knew or should have known about the dangerous conditions and did nothing to fix them. Cristina Ciminelli, one of the attorneys representing Nijjar Realty and Pama Management, said Thursday she had not yet received the lawsuit. She said it’s a tragic case, and an investigation is ongoing with the cooperation of the plaintiffs’ lawyers to determine the cause of the fire. She said there appears to have been a space heater in the room with Jenica, but it has not been determined if that ignited the blaze. “Once we have a better understanding of what happened we can assess liability,” Ciminelli said. The lawsuit seeks general and special damages according to proof, and punitive and exemplary damages “based on the defendants’ willful, malicious, wanton and fraudulent misconduct in an amount to be proven at trial.” The fire destroyed the mobile home with the child inside and the homes adjacent to it. Kern County firefighters estimated total damage at $90,000. Firefighters tried rescuing Jenica but couldn’t reach her as the fire had spread throughout the home.
