Serious Personal Injury Lawsuit Claims Massage Caused Stroke

Dallas woman files serious personal injury lawsuit after suffering stroke following deep tissue massage.

Days after having a deep tissue massage at Massage Envy, a Dallas woman suffered a stroke which left her wheelchair-bound. She is suing the Massage Envy location in Uptown, its parent company, and a specific massage therapist. In 31 years of marriage, Frank and Barbara Kubiak spent many years doing what they love, until they say a single massage changed everything. “It’s the saddest thing I’ve ever gone through,” said Barbara, sitting in the wheelchair she’s had for more than a year. Barbara used to work out daily, and has had a clean bill of health from doctors throughout her 60s. To take out tension in her back, she signed a contract with Massage Envy’s Uptown Dallas location. In April of 2014, she went in for one of her bi-monthly deep tissue massages with a therapist she’d used before. “[It was] very aggressive,” she said. She says she left that day with bruises, but she figured it was normal. It became her last appointment because of what happened 11 days later. “I sat up on the bed, and I kept falling over to the left,” Barbara said. “By that time, she was trying to get up, stand up, and she fell over,” Frank said, “and I was like, ‘There is something bad wrong with you.'” Barbara had a stroke and lost all feeling on her left side. Frank now helps his wife bathe, gets her dressed, and carries her to cars. Their days of golf and grand travel plans feel like they’re done. The Kubiaks say doctors asked if Barbara had any blunt trauma to her neck that would cause her carotid artery in her neck dissect, leak, and lead to stroke. There was nothing. Their attorney, Ron McCallum, says Massage Envy is to blame, due to what doctors told them caused Barbara’s stroke. “‘Specific trauma secondary to specific manipulation,'” McCallum said. “In other words, human hands inappropriately and roughly touching and manipulating her neck.” So they have filed a serious personal injury lawsuit against the company, the location, and the therapist, saying each broke Barbara’s trust and changed her world. In response to the suit, Massage Envy spokeswoman Karen Sung sent News 8 this statement: “While we cannot comment on specific litigation, we can tell you that Massage Envy is dedicated to providing a safe and professional environment.
