California Wrongful Death Attorneys Successfully Resolve Elder Abuse Case

Pasadena civil trial firm, Ball & Roberts, wins negligence case settlement for family of late nursing home patient.

Cooperating with the state of California, the team of wrongful death attorneys at Ball & Roberts have confidentially resolved an elder abuse matter. The case involved a post-stroke nursing home resident who, while attempting to light a cigarette, dropped the match onto his lap, which caused him to catch fire and burn 50% of his body. He died three weeks later from an infection that was secondary to the burns.

Ball & Roberts had to resolve whether the negligence was related to the rendering of medical care or, alternately, custodial care. The answer to that question was the determining factor for whether the heirs were limited to malpractice caps.
